CEMETERY ORDINANCE #49

To the residents and property owners of the Township Of Freedom, Washtenaw County, Michigan.

An ordinance adopted pursuant to Public Act 246 of 1945 as amended (MCL 41.181 et seq.) to protect the public health, safety and general welfare of the residents and property owners of the Township of Freedom, Washtenaw County, Michigan, to update and amend the “Freedom Township Cemetery Ordinance” by establishing regulations relating to the operation, control, and management of cemeteries owned by the Township of Freedom, Washtenaw County, Michigan; to provide penalties for the violation of the ordinance, and to repeal all ordinances or parts of ordinances in conflict therewith.  It is also intended that this ordinance will serve as a means of achieving a peaceful and respectful setting for the burial of the dead while permitting reasonable opportunities for persons to care for, beautify, adorn and improve burial space sites within the cemetery.

This Ordinance was duly adopted by the Freedom Township Board at its regular meeting called and held on August 13th, 2019 and was ordered given publication in the manner required by law. ORDINANCE NO. 49

Section 1.           This section states the title of the Ordinance.

Section 2.           This section states the general rules allowed outlined by this Ordinance.

Section 3.           This section states the definitions or words and phrases used in the Ordinance.

Section 4.           This section states the sale of burial rights for lots and burial spaces.

Section 5.           This section states the purchase price and transfer fees.

Section 6.           This section states additional charges and restrictions.

Section 7.           This section states the rules regarding markers or memorials for burial spaces.

Section 8.           This section states the interment regulations.

Section 9.           This section states the rules for ground maintenance.

Section 10.         This section states the procedure for forfeiture of vacant cemetery lots or burial spaces.

Section 11.         This section states the process to repurchase lots or burial spaces.

Section 12.         This section states the process to retain records.

Section 13.         This section states the guidelines for a vault and/or urn.

Section 14.         This section states the penalties of the Ordinance.

Section 15.         This section states the severability of the Ordinance.

Section 16.         This section states all ordinances or parts of ordinances in conflict with this are hereby repealed.

Section 17.         This section provides that the savings clause of the Ordinance

Section 18.         This section provides that the Ordinance shall take effect 30 days after it (or a summary of it) is published in a newspaper of general circulation within the Township.
