City of Dexter: Adoption of Ordinance 2024-05

ORDINANCE NO. 2024-05

AN ORDINANCE AMENDING THE CITY OF DEXTER ZONING ORDINANCE BY INCORPORATING AN AMENDMENT TO THE OFFICIAL ZONING MAP TO CHANGE A CERTAIN LAND AREA, LOCATED ON AT 2505 BAKER ROAD, 08-08-06-400-018, IN THE CITY OF DEXTER, FROM PF, PUBLIC FACILITIES TO VR-1, VILLAGE RESIDENTIAL 1 DISTRICT.

The City Council of the City of Dexter hereby ordains:

SECTION 1.  ADOPTION OF AMENDMENT TO OFFICIAL ZONING MAP.

            WHEREAS, a proposed rezoning amendment from PF, Public Facilities To VR-1, Village Residential 1 District, has been submitted by the City pursuant to Article XXIII, Amendments Procedure, of the City of Dexter Zoning Ordinance, and,

WHEREAS, said proposal affects a land area with the current tax parcel ID numbers:

                        Property Code:              08-08-06-400-018

                        Commonly known as:    2505 Baker Road

                                    Owner on Tax Roll:       Dexter Community Schools

            WHEREAS, the proposed zoning classification amendment has been duly advertised, and presented at a public hearing held by the City Planning Commission on May 6, 2024, in accordance with the requirements of Public Act 110 of 2006, as amended. 

WHEREAS, this proposal has been reviewed by the City Planning Commission and was recommended for approval to the City Council, and,

            THEREFORE, BE IT ORDAINED THAT: the City Council of the City of Dexter does hereby adopt VR-1, Village Residential 1 District, as described above, as an amendment to the official Zoning Map, and 

            BE IT FURTHER ORDAINED THAT: this amendment shall be made to the Official City Zoning Map.

SECTION 2.  AVAILABILITY.  

The Official Zoning Map is available for inspection at the City Office. Supporting documentation for each zoning district designation is available in the Office of the Community Development Manager at the City Office. Copies of the Zoning Map or the Zoning Ordinance text, as amended, are available on-line at www.dextermi.gov. The City Office is located at 3515 Broad Street, Dexter, MI 48130. Normal business hours are 9:00 am to 5:00 pm Monday through Friday.

SECTION 3.  INCONSISTENCIES REPEALED.  

Any and all other ordinances or resolutions or parts thereof in conflict herewith are hereby repealed.

SECTION 4.   SEVERABILITY.

Should any section, clause or paragraph of this Ordinance be declared by court of competent jurisdiction to be invalid, the same will not affect the validity of the ordinance as a whole or part hereof other than the part declared to be invalid.

SECTION 5.  SAVING CLAUSE. 

That nothing in this Ordinance shall be construed to affect any suit or proceeding impending in any court, or any rights acquired, or liability incurred, or any cause or causes of action acquired or existing, under any act or ordinance hereby repealed; nor shall any just or legal right or remedy of any character be lost, impaired or affected by this Ordinance.

SECTION 6.  EFFECTIVE DATE. 

The provisions of this map amendment are hereby ordered to take effect seven (7) days following its publication in a newspaper of general circulation within the City. This Ordinance is hereby declared to have been adopted by the City Council of the City of Dexter in a meeting duly called and held onAugust 12, 2024.
