Dexter Township Resolution #17- 473

RESOLUTION TO EXTEND A MORATORIUM ON THE ACCEPTANCE OF ANY NEW APPLICATIONS FOR OPEN SPACE COMMUNITIES, SITE CONDOMINIUMS, AND PLATTED SUBDIVISIONS IN DEXTER TOWNSHIP FOR UP TO A SIX (6) MONTH PERIOD SO THAT THE PLANNING COMMISSION AND TOWNSHIP BOARD MAY FINALIZE THE CHANGES TO THE ZONING ORDINANCE OF DEXTER TOWNSHIP

WHEREAS, Dexter Township (Township), Washtenaw County, Michigan, currently has in place a Zoning Ordinance which allows for the residential use and development of property and that substantially all of the remaining undeveloped parcels within the Township are presently zoned and planned for residential development; and



WHEREAS, the Township is likely to receive applications from property owners for Open Space Communities, Site Condominiums, and/or Platted Subdivisions due to present market conditions; and

WHEREAS, the Township has been actively drafting, reviewing, and approving changes to its Zoning Ordinance since 2013, including the Open Space Communities, Site Condominium, and Platted Subdivision Articles; and

WHEREAS, this drafting, reviewing, and approval process is nearing its conclusion; and

WHEREAS, one of the purposes of the Zoning Ordinance is to promote the health, safety, and welfare of the Township citizens; and

WHEREAS, the Township considers well-planned residential developments to be essential to meeting this purpose of the Zoning Ordinance and the goals and objectives of the Township’s Master Plan; and

WHEREAS, the Township Board and the Planning Commission have expressed a desire to complete the pending changes to the Zoning Ordinance before any more Open Space Communities, Site Condominiums, and/or Platted Subdivisions are approved; and

WHEREAS, the Township Board has determined that it is in the best interests of the citizens of Dexter Township and otherwise appropriate to extend the current moratorium on the acceptance of any new applications for Open Space Communities, Site Condominiums, and/or Platted Subdivisions within the Township to allow the Planning Commission and the Township Board to review and adopt modifications to the Zoning Ordinance and other police power ordinances, as appropriate; and

WHEREAS, the Township Board, July 19, 2016, adopted Resolution 16-468, imposing a six (6) month moratorium on acceptance of any new applications for Open Space Communities, Site Condominiums, and/or Platted subdivisions, which will soon expire;

NOW, THEREFORE, BE IT RESOLVED, that Dexter Township hereby extends the moratorium on the acceptance of any new applications to the Township by property owners or their agents for Open Space Communities, Site Condominiums, and/or Platted Subdivisions for period of six (6) months from the date of adoption of this Resolution or until such time as the Township Board cancels or revokes this moratorium by further resolution, in order to allow the Planning Commission and the Township Board to develop and implement, as necessary, modifications to the Dexter Township Zoning Ordinance to appropriately regulate Open Space Communities, Site Condominiums, and/or Platted Subdivisions the Township;

BE IT FURTHER RESOLVED, that the Planning Commission and the and Zoning Administration are hereby prohibited from accepting any new applications for Open Space Communities, Site Condominiums, and/or Platted Subdivisions within Dexter Township for a period of six (6) months from the date of adoption of this Resolution, or until such earlier time as the Township Board cancels or revokes this moratorium by further resolution.

All resolutions or parts of resolution insofar as they may conflict with provisions of this Resolution, be and they are hereby rescinded.
