ORDINANCE NO. 2018 – 02
AN ORDINANCE AMENDING THE CITY OF DEXTER ZONING ORDINANCE BY INCORPORATING AN AMENDMENT TO THE OFFICIAL ZONING MAP TO CHANGE A CERTAIN LAND AREA, COMMONLY KNOWN AS 7931 Grand Street (08-08-06-155-001), 7905 Grand Street (08-08-06-427-001), 08-08-06-427-002 (Vacant Baker Road) OF THE CITY OF DEXTER FROM I-1 LIMITED INDUSTRIAL TO VR, VILLAGE RESIDENTIAL WITH A PUD OVERLAY AND 7961 Grand Street (08-08-06-285-004) OF THE CITY OF DEXTER FROM VR VILLAGE RESIDENTIAL TO VR VILLAGE RESIDENTIAL WITH A PUD OVERLAY.
The City Council of the City of Dexter hereby ordains:
SECTION 1. ADOPTION OF AMENDMENT TO OFFICIAL ZONING MAP.
Whereas, a proposed rezoning amendment from, I-1 LIMITED INDUSTRIAL to VR, VILLAGE RESIDENTIAL WITH A PUD OVERLAY and VR VILLAGE RESIDENTIAL to VR VILLAGE RESIDENTIAL WITH A PUD OVERLAY, has been submitted by the City pursuant to Article XIX of the City Zoning Ordinance, and,
Whereas, this proposal has been reviewed by the City Planning Commission and recommended for approval to the City Council, and,
Whereas, the proposed zoning classification amendment has been duly advertised and presented at a public hearing held by the City Planning Commission, pursuant to requirements of Public Act 110 of 2006 as amended.
Whereas, said proposal affects a land area with the current tax parcel ID numbers:
Be it therefore ordained that: the City Council of the City of Dexter does hereby adopt VR VILLAGE RESIDENTIAL WITH A PUD OVERLAY, as described above, as an amendment to the official Zoning Map, upon execution and recording of the Planned Unit Development Agreement for Grandview Commons.
Be it further ordained that: this amendment shall be made to the Official City Zoning Map.
SECTION 2. AVAILABILITY.
The Official Zoning Map is available for inspection at the City Office. Supporting documentation for each zoning district designation is available in the Office of the Community Development Manager at the City Office. Copies of the Zoning Map or the Zoning Ordinance text, as amended, are available on-line at www.dextermi.gov. The City Office is located at 8123 Main Street, Dexter, MI 48130. Normal business hours are 9:00 am to 5:00 pm Monday through Friday.
SECTION 3. INCONSISTENCIES REPEALED.
Any and all other ordinances or resolutions or parts thereof in conflict herewith are hereby repealed.
SECTION 4. SEVERABILITY.
Should any section, clause or paragraph of this Ordinance be declared by court of competent jurisdiction to be invalid, the same will not affect the validity of the ordinance as a whole or part hereof other than the part declared to be invalid.
SECTION 5. SAVING CLAUSE.
That nothing in this Ordinance shall be construed to affect any suit or proceeding impending in any court, or any rights acquired, or liability incurred, or any cause or causes of action acquired or existing, under any act or ordinance hereby repealed; nor shall any just or legal right or remedy of any character be lost, impaired or affected by this Ordinance.
SECTION 6. EFFECTIVE DATE.
The provisions of this map amendment are hereby ordered to take effect seven (7) days following its publication in a newspaper of general circulation within the City. This Ordinance is hereby declared to have been adopted by the City Council of the City of Dexter, in a meeting duly called and held on February 22, 2017, following the execution and recording of the Planned Unit Development Agreement for Grandview Commons on February 15, 2018.
