Ordinance No. 2026-02

QUIKTRIP CONDITIONAL REZONING

An application for conditional rezoning of 525, 597, 609, and vacant Baker Road properties (H-08-18-400-004, 007, 008, 009, 034), from R-1, Single-Family Residential to C-3, Highway Commercial.  The Planning Commission held the required public hearing on January 12, 2026, and recommended approval of the rezoning to the Township Board.

BY AUTHORITY OF PUBLIC ACT #110 OF 2006, AS AMENDED, SCIO TOWNSHIP, WASHTENAW COUNTY, MICHIGAN, HEREBY ORDAINS

Section 1. Rezoning

Parcels H-08-18-400-004, 007, 008, 009, 034, Scio Township, Washtenaw County, Michigan is hereby rezoned from R-1, Single-Family Residential to C-3, Highway Commercial with the following conditions voluntarily offered by the applicant:

  1. The property may only be developed for the following permitted use: vehicle filling station, vehicle wash and minor vehicle repair facility subject to the provisions of Section 36-137. 
    1. The property may only be developed for the following uses if conditional land use is approved: (a) truck stop facilities, subject to the provisions of section 36-137; or (b) fast food and carry-out restaurants.
    1. A conservation easement will be placed on approximately 3.45 acres on the western side of the site to restrict the development of that area and preserve the natural landscape.
    1. The rezoning is conditioned on final site plan approval of QuikTrip’s proposed development, such that if final site plan approval is not granted (after exhaustion of all administrative and appeal rights) the property will revert back to Single-Family Residential R-1 and there will be no conservation easement on the approximately 3.45 acres on the western side of the site.

Section 2. Zoning Map

The Scio Township Zoning Map is hereby amended to reflect this rezoning.

Section 3. Recording

After adoption, a copy of this ordinance, or an affidavit documenting the conditions of the rezoning may be recorded with the Washtenaw County Register of Deeds.

Section 4. Repealer

All ordinances or parts thereof which are in conflict with the provisions of this Ordinance are, to the extent of such conflict, hereby repealed, except that terms defined herein for the purpose of interpretation, administration and enforcement of this Ordinance shall not act to modify, repeal or otherwise change the definition of any such term as used in other ordinances or laws. 

Section 5. Savings Clause

The provisions of this Ordinance are hereby declared to be severable.  If any clause, sentence, paragraph, section or subsection is declared void or inoperable for any reason by any court, it shall not affect any other part or portion hereof other than the part declared void or inoperable.

Section 6. Adoption and Effective Date

This Ordinance shall be published in the manner as required by law. Except as otherwise provided by law, this Ordinance shall be effective upon the eighth day following final publication of the Ordinance or at such later date after publication as may be specified by the Township Board.

This Ordinance was duly adopted by the Township Board at this regular meeting called and held on the 10 day of February, 2026, and was ordered giving publication in the manner required by law.
