TOWNSHIP OF SHARON RESOLUTION NO. 2026- 02-05-01

MORATORIUM ON ISSUANCE OF PERMITS AND APPROVALS FOR DATA CENTERS

At a regular meeting of the Township Board of the Township of Sharon held at the Township Hall on the Sth day of February 2026, at 6:00 p.m.

Motion by Trustee Cooper, seconded by Treasurer Brickley, that the following Resolution be adopted.

WHEREAS, There has been a myriad of applications for approvals of data centers over the last year throughout Southeast and Lower Michigan and it is unknown by the Township of Sharon whether such data centers would be compatible with other land uses in the Township, and whether such data centers would have substantial impact on the public safety, environment, and welfare of the citizens of Sharon Township.

WHEREAS, it is unknown by the Township of Sharon whether the Township has necessary and sufficient local regulations, standards, and zoning ordinances for such data centers so as to protect potential neighboring land uses, the environment, and the health, safety and welfare of the citizens of the Township.

WHEREAS, Sharon Township needs to make sure that it has a well-planned balance of residential and commercial development within the Township for the Township’s financial well-being and the health, safety, and welfare of its citizens.

WHEREAS, the Township of Sharon desires to have time to review its Master Plan as well as its existing Zoning Ordinances, regulations, and standards to make certain that it has carefully considered what reasonable guidelines, and regulations may be necessary to protect property owners, the Sharon Township community, and the environmental assets of the Township, from potential impacts of data centers and to ensure the productive and healthy development of any data centers within Sharon Township. WHEREAS, the Board of Trustees of Sharon Township believes it is necessary and appropriate to establish a temporary moratorium on the acceptance and processing of any applications, permits, and/or sife plans for any data centers or similar data storage facilities in the Township of Sharon for a period of twelve (12) months or until such time as the Township Board determines that the Township has sufficient guidelines, regulations, zoning ordinances and standards in place as may be necessary to protect property owners, the Sharon community, and the environmental assets of the Township, from potential impacts of data centers.

NOW, THEREFORE, IT IS ORDAINED BY THE SHARON TOWNSHIP BOARD OF TRUSTEES AS FOLLOWS:

  1. A Data Center or similar data storage facility shal! mean a facility whose primary purpose is the storage, processing, and transmission of digital data and information and such facility houses computer and/or network equipment, servers, appliances, systems, and other components associated with digital and electronic data storage and operations.
  2. A temporary moratorium is hereby adopted on the acceptance and processing of any applications, permits, and/or site plans for any data centers or similar data storage facilities in the Township of Sharon for a period of twelve (12) months, except as otherwise stated in Section 3.
  3. This temporary moratorium shall be effective from February 5, 2026, at 11:59 P.M. until February 5, 2027, at 11:59 P.M., or until such time as the Board of Trustees determines that the Township has sufficient guidelines, regulations, zoning ordinances, and standards in place as may be necessary to protect property owners, the Sharon community, and the enVironmental assets of the Township, from potential impacts of data centers, whichever occurs first.
  4. If any other ordinance or part thereof is in conflict with this ordinance and moratorium, this ordinance shal! prevail.
  5. This ordinance shall become effective immediately upon publication.
