NOTICE OF ADOPTION

Notice is hereby given that the Township Board for Sylvan Township, Washtenaw County, Michigan adopted Ordinance 24 03; that provides an amend to Chapter 30 Zoning: Article III District Regulations, Division 1 Generally, Section 30-182; Article III District Regulations, Division 6 LR-Low Density Residential District, Section 30-348 Regulations and performance standards; and Article X Nonconformities, Section 30-841 Nonconforming Structures at a regular meeting held on June 4, 2024. Summaries of the amendments are below.

Chapter 30 Zoning;
Article III District Regulations;
Division 1 Generally;
Section 30-182;
Item (b)(3)-Amended to include wording that would allow mechanical equipment on residential property to encroach 5 feet into a required setback as long as the equipment is no closer than 5 feet from any property line.

Division 6 LR-Low Density Residential District;
Section 30-348 Regulations and performance standards;
Item (3)-Amended to allow 30% lot coverage
Item (4)-Amended to allow 30% floor area ratio
Item (5)(b)-Amended to include graduated side yard setbacks for lots with a lot width of less than 80 feet.
Item (5)(d)– Amended to clarify the setback regulations for lots with multiply street frontages.
Article X Nonconformities;

Section 30-841 Nonconforming Structures
Item (b)-Amended the regulation to allow replacement of nonconforming structures damaged by any means, on nonconforming lots of record regardless, of the replacement cost.

A copy of the full text of the new Zoning Ordinance amendments may be inspected or purchased at the Township Offices (18027 Old US-12, Chelsea, MI 48118). The new Zoning Ordinance Amendments will also be posted on the Township’s website at https://sylvantownshipmi.gov/planning-commission/
The adopted amendment shall become effective 7 days after the notice is published, unless referendum procedures are initiated under MCL 125.3402 within seven (7) days after publication of this notice of adoption. If referendum procedures are initiated, the ordinance shall take effect in accordance with MCL 125.3402.
