Webster Twp: Adoption of Municipal Penalty, Civil Infraction, and Appearance Tickets Ordinance

NOTICE OF ADOPTION OF WEBSTER TOWNSHIP MUNICIPAL PENALTY, CIVIL INFRACTION AND APPEARANCE TICKETS ORDINANCE

Ordinance No. 2023-01 & Resolution No. 02-23 as adopted on January 17, 2023

At a regular meeting of the Township Board of Webster Township, Washtenaw County, Michigan, held at the Webster Township Hall on January 17, 2023 at 7 p.m., Township Board Member Harms moved to adopt the following ordinance, which motion was seconded by Township Board Member Vrsek.

YEAS: Harms, Kingsley, Munzel, Scharf, Vrsek, Westman; NAYS: None; ABSENT: Calleja

An ordinance providing for municipal civil infractions of certain Township ordinances and penalties pursuant thereto; establishing procedures relating thereto; authorization of which Township Officials can issue civil infraction tickets and appearance tickets; penalties; and procedures relating to such matters.

The Township of Webster, Washtenaw County, Michigan Ordains:

Section 1. Title. This ordinance shall be known as the “Webster Township Municipal Penalty, Civil Infraction and Appearance Tickets Ordinance.”

Section 2: Definitions

Section 3: Municipal Civil Infraction Action; Commencement

Section 4: Municipal Civil Infraction Citations; Issuance and Service

Section 5: Municipal Civil Infraction Citations; Contents

Section 6: General Penalties and Sanctions for Violations of Township Ordinances; Continuing Violations; Injunctive Relief

Section 7: Authorized Persons-Civil Infractions Tickets

Section 8: Authorized Persons-Misdemeanor Appearance Tickets

Section 9: Applicability of the Act

Section 10: Severability

Section 11: Effective Date. This Ordinance shall become effective thirty (30) days after its publication (or publication of a summary thereof) in a newspaper in general circulation within Webster Township.

NOTICE OF ADOPTION OF AN AMENDMENT TO WEBSTER TOWNSHIP PUBLIC NUISANCE ORDINANCE

Ordinance No. 2011-1 & Resolution No. 01-23 as adopted on January 17, 2023

At a regular meeting of the Township Board of Webster Township, Washtenaw County, Michigan, held at the Webster Township Hall on January 17, 2023 at 7 p.m., Township Board Supervisor Kingsley moved to adopt the following ordinance, which motion was seconded by Township Board Member Vrsek.

YEAS: Harms, Kingsley, Munzel, Scharf, Vrsek, Westman; NAYS: None; ABSENT: Calleja

An ordinance to promote the health, safety, and welfare of the people of Webster Township, Washtenaw County, Michigan, by defining and prohibiting public nuisances; declaring certain acts, apparatus, accumulations, violations, and activities as public nuisances per se;

The Township of Webster, Washtenaw County, Michigan Ordains:

Amendment to section 3.1., 5, 6certain standards and addition of new standards to Section 3: PUBLIC NUISANCES PER SE. to address general regulations, noise regulations, animal care, animal restraint and animal bites.

The following sections are amended in its entirety:

Section 3.1. to define clearly audible and quiet hours

Section 3.6.a. to clarify general regulation.

Section 3.6.b. to address specific noise violations

The following sections are added:

Section 3.6.d. to address noise complaints

Section 3.7. to address animal care

Section 3.8. to address animal restraint.

Section 3.9. to address animal bites.

No changes are made to the following sections:

Section 3.1.a. thru 3.1.c.

Section 3.2. thru 3.5.

Section 3.6.c. Exceptions
