Dexter: Adoption of Zoning Ordinance Amendment

AN ORDINANCE AMENDING THE 2023 CITY OF DEXTER ZONING ORDINANCE BY INCORPORATING AMENDMENTS TO ARTICLE XI, FORM-BASED DISTRICTS

The City Council of the City of Dexter hereby ordains:

SECTION 1: The City of Dexter 2023 Zoning Ordinance is amended by REVISION of Article XI, Section 11.10 Form-Based District Use Table to add Multiple Family Dwellings as a Special Land Use in the VR-2 District, for Site Type B Parcels fronting on Village Streets and only if adaptive re-use. Adaptive reuse is exclusive of single-family and two-family dwellings.

The full text has been omitted from this notice due to its length, but it is available for review at the City Offices 3515 Broad St, Dexter, MI 48130 from 9:00 am to 5:00 pm on business days and on the City’s website at www.dextermi.gov.

SECTION 2: INCONSISTENCIES REPEALED. Any and all other ordinances or resolutions or parts thereof in conflict herewith are hereby repealed.

SECTION 3: SEVERABILITY. Should any section, clause or paragraph of this Ordinance be declared by court of competent jurisdiction to be invalid, the same will not affect the validity of the ordinance as a whole or part hereof other than the part declared to be invalid.

SECTION 4: SAVING CLAUSE. That nothing in this Ordinance shall be construed to affect any suit or proceeding impending in any court, or any rights acquired, or liability incurred, or any cause or causes of action acquired or existing, under any act or ordinance hereby repealed; nor shall any just or legal right or remedy of any character be lost, impaired or affected by this Ordinance.

SECTION 5: EFFECTIVE DATE. The provisions of this amendment are hereby ordered to take effect seven (7) days following its publication in a newspaper of general circulation within the City. This Ordinance is hereby declared to have been adopted by the City Council of the City of Dexter in a meeting duly called and held on June 12, 2023.

Day of June 2023, that the above Ordinance was ADOPTED after a Public Hearing and Recommendation by the City of Dexter Planning Commission and that the following members were present:

Hubbard, Michels, Griffin, Aldag, Schlaff, Semifero, and Keough

That upon motion made by Semifero and seconded by Hubbard, said Ordinance was ADOPTED on the following roll call vote:

Ayes: Hubbard, Michels, Griffin, Aldag, Schlaff, Semifero, Keough

Nays: None

Absent: None

I further certify that on the 5th Day of July 2023, I caused a summary of the regulatory effect of said Ordinance to be published in The Sun Times News, a newspaper circulated in the City of Dexter, and that said Ordinance and the record of publication was duly recorded in the Book of Ordinances of the City of Dexter and is available for public use and inspection at the offices of the City of Dexter. The Ordinance shall take effect seven (7) days after publication.
