Saline: Notice of ordinance amendment

ORDINANCE No. 843

AN ORDINANCE TO AMEND SECTION 22-93 OF ARTICLE V “ADULT USE MARIHUANA ESTABLISHMENTS” and SECTION 22-113 OF ARTICLE VI “MEDICAL MARIHUANA FACILITIES” Of THE CITY OF saline CODE OF ORDINANCEs IN ORDER TO CLARIFY AND CONFIRM THE MEASUREMENT OF SEPARATION DISTANCES.

The City of Saline ordains:

Section 1. Amendment. The City of Saline Code of Ordinances is hereby amended by replacing subsection 22-93 of Article V in its entirety to read as follows:

Sec. 22-93. Marihuana establishments authorized.

Pursuant to the MRTMA, the city authorizes the operation in the city of the following adult use marihuana establishments, provided they possess a state operating license issued under the MRTMA and they comply with the additional requirements of this article, the city zoning ordinance designated as appendix A, and all other applicable laws and ordinances:

(1) Processor.

(2) Retailer.

(3) Secure transporter.

(4) Safety compliance facility.

Notwithstanding anything to the contrary in this article, except those retailers and provisioning centers that are co-located, no parcel containing a retailer shall be located within one thousand (1,000) feet of neither a parcel containing a medical marihuana provisioning center as licensed pursuant to the MMFLA and Article VI, Medical Marihuana facilities nor a parcel containing another retailer. In addition, no parcel containing either a retailer or provisioning center shall be located within 1,000 feet of school property. In addition, except those retailers and provisioning centers that are co-located, no retailer shall be located on the same parcel as a medical marihuana provisioning center. For the purposes of this article only, "school" means "a public, private, denominational, or parochial school offering developmental kindergarten, kindergarten, or any grade from 1 through 12" and "school property" means "a building, playing field, or property used for school purposes to impart instruction to children or used for functions and events sponsored by a school, except a building used primarily for adult education or college extension courses." The above separation distances shall be measured by measuring the shortest straight line distance between parcel property lines subject to separation.

Notwithstanding the use of the term establishment or marihuana establishment or equivalent licenses, and for the purposes of clarity, growers, including class A growers, class B growers, class C growers, and microbusinesses are prohibited in the city and no application will be accepted nor city permit issued therefor.

Section 2. Amendment. The City of Saline Code of Ordinances is hereby amended by replacing subsection 22-113 of Article VI in its entirety to read as follows:

Sec. 22-113. Marihuana facilities authorized.

Pursuant to the MMFLA, the city authorizes the operation in the city of the following marihuana facilities, provided they possess a state operating license issued under the MMFLA and they comply with the additional requirements of this article, the city zoning ordinance designated as appendix A, and all other applicable laws and ordinances:

(1) Processor.

(2) Provisioning center.

(3) Secure transporter.

(4) Safety compliance facility.

Notwithstanding anything to the contrary in this article, except those retailers and provisioning centers that are co-located, no parcel containing a provisioning center shall be located within one thousand (1,000) feet of neither a parcel containing another provisioning center nor a parcel containing a retailer as licensed pursuant to the MTRMA and Article V, Adult Use Marihuana Establishment. In addition, no parcel containing either a retailer or provisioning center shall be located within 1,000 feet of school property. In addition, except those retailers and provisioning centers that are co-located, no provisioning center shall be located on the same parcel as an adult use marihuana retailer. For the purposes of this article only, "school" means "a public, private, denominational, or parochial school offering developmental kindergarten, kindergarten, or any grade from 1 through 12" and "school property" means "a building, playing field, or property used for school purposes to impart instruction to children or used for functions and events sponsored by a school, except a building used primarily for adult education or college extension courses." Notwithstanding the use of the term facility or marihuana facility, and for the purposes of clarity; growers, including class A growers, class B growers, and class C growers are prohibited in the city and no application will be accepted nor city permit issued therefor.

Section 3. Effective Date. This ordinance shall become effective 10 days after its publication.
