THE TOWNSHIP OF SCIO, WASHTENAW COUNTY, MICHIGAN, HEREBY ORDAINS:
Section 1:
Chapter 2, Sec. 2-42 of the Township of Scio Code of Ordinances, Indemnification of Township Officers and Employees, is amended as follows:
Pursuant to section 8 of Public Act No. 170 of 1964 (MCL 691.1408), the township authorizes the indemnification of past and present public officers and past and present employees while acting on behalf of the township within the scope of their authority as stated below:
Whenever aIf claim is made or a civil action is commenced against anypast or presentofficer orpast or presentemployee, or volunteer of the township for injuries to persons or propertyallegedlycaused by negligence of the officer,oremployee, or volunteer whileacting withinin the course of employment with or acting on behalf of the township and while acting within the scope of his or her authority, the townshipshallmay pay for, engage, or furnish the services of an attorney to advise the officer,oremployee, or volunteer as to the claim and to appear for and represent the officer, employee, or volunteer in the action. The board of trustees may compromise, settle, and pay the claim before or after the commencement of a civil action.WheneverIf a judgment for damages is awarded against an officer, employee, or volunteer of the township as a result of a civil action for personal injuries or property damage caused by the officer, employee, or volunteer while in the course of employment and while acting within the scope of his or her authority, the townshipshallmay indemnify the officer, employee, or volunteer or pay, settle, or compromise the judgment.
WheneverIf a criminal action is commenced againsta past or presentan officer or past or present employee of the township based upon the conduct of the officer or employee in the course of employment, if the employee or officer had a reasonable basis for believing that he
or she was acting within the scope of his or her authority at the time of the alleged conduct, the township shall may pay for, engage, or furnish the services of an attorney to advise the officer or employee as to the action and to appear for and represent the officer or employee in the action.
Section 2. Repealer
All ordinances or parts thereof which are in conflict with the provisions of this Ordinance are, to the extent of such conflict, hereby repealed, except that terms defined herein for the purpose of interpretation, administration and enforcement of this Ordinance shall not act to modify, repeal or otherwise change the definition of any such term as used in other ordinances or laws.
Section 3. Savings Clause
The provisions of this Ordinance are hereby declared to be severable. If any clause, sentence, paragraph, section or subsection is declared void or inoperable for any reason by any court, it shall not affect any other part or portion hereof other than the part declared void or inoperable.
Section 4. Adoption and Effective Date
This Ordinance shall be published in the manner as required by law. Except as otherwise provided by law, this Ordinance shall be effective 30 days after publication.
