Order for Alternate Service Pursuant to MCR 2.105(J) and 2.106
At a session of this Court, held in the City of Ann Arbor, Washtenaw County, Michigan, held this 11th day of April, 2024.
Present: Hon. Carol Kuhnke Circuit Court Judge
- Plaintiff City of Dexter (City) filed a lawsuit in this 22nd Circuit Court, Washtenaw County Circuit Court, with the City as plaintiff and the Heirs of Jacob Rehm and the Estate of Jacob Rehm as defendants (the Defendants).
- The City seeks to quiet title to a small, landlocked, parcel of land, located in the Downtown area of the City of Dexter (the Land), and to terminate the ownership interests of the Heirs of Jacob Rehm and the Estate of Jacob Rehm in the Land. The Land is located behind the building located at 8050 Main Street, Dexter, Michigan.
- The Defendants may have an ownership interest in the Land because it was owned by the Estate of Jacob Rehm in 1927, and it was never conveyed out to any third parties; as such, the Defendants may still have an ownership interest.
- The City believes it has extinguished all of Defendants’ interests in the Land through the principles of adverse possession and acquiescence, and has filed this lawsuit to perfect the City’s interest in the Land.
- The Defendant(s) should answer the complaint, if at all, within 28 days after publication and/or posting is completed, by delivering their answer to the Washtenaw County Circuit Court Clerk, located at 101 E. Huron Street, Ann Arbor, MI 48107, with a copy to counsel for the City at the address stated above. The Defendants may need to file their answer electronically through the MiFile system used by the Washtenaw County Circuit Court. (Publication and posting will be completed by May 30, 2024; therefore, an answer to the complaint would be due on or before June 27, 2024.)
- If the Defendants fail to answer the complaint on or before the date stated in Paragraph 5 above, the City will seek to have a default judgment entered against the Defendants, thus terminating any ownership interests the Defendants may have in the Land.
- The City must have this order published for three consecutive weeks, consistent with MCR 2.106(D)(1).
- The City must post a copy of this order for three consecutive weeks at a) the Washtenaw County Courthouse; b) both the front and the back of the building located at 8050 Main Street (which building is in front of the Land); and c) the Dexter City Hall, located at 3515 Broad Street, Dexter, Michigan, all consistent with MCR 2.106(E)(1). The Washtenaw County Sheriff, Civil Bureau, must post the order and file a proof of posting.
- Pursuant to MCR 2.106(B), (D)(2), and (E)(2), the City does not need to mail a copy of this order to Defendants.
This order does not resolve the last pending claim and does not close the case.
