Lyndon Twp: Notice of Amendment Adoption

LYNDON TOWNSHIP

WASHTENAW COUNTY, MICHIGAN

NOTICE OF ADOPTION (ZTA 25-001)

Notice is also hereby given that the Township Board for Lyndon Township, Washtenaw County, Michigan adopted zoning text amendment (ZTA 25-001) which will amend the Township Zoning Ordinance as follows:

Chapter 2 Definitions

Section 2.02 Definitions-A

Accessory Building: Amends definition to include ground mounted and standalone renewable energy systems.

Adult Day Care Facility: Removed the definitions of Adult Family Day Car Home, Adult Group Day Care Home and Adult Day Care Center

Adult Foster Care Facility: Amends the overall definition and the definitions of Adult Foster Care Family Home, Adult Foster Care Small Group Home, Adult Foster Care Large Group Home and Adult Foster Care Congregate Facility  to comply with the State of Michigan requirements.

Section 2.03 Definitions-B

Batter Energy Storage System: Adds definitions for Large-scale and Small-scale Batter Energy Storage Systems.

Batter Management System: Adds definition for Batter Management System.

Building: revises definition to include small scale renewable energy systems attached to a building.

Section 2.04 Definitions-C

Child Care Facility: Revises definitions of Family Child Care Home, Group Child Care Home, and Child Care Center to comply with the State of Michigan requirements.

Section 2.05 Definitions-D

Day Care Facility: Removes the definitions for Family Day Care Facility, Group Day Care Facility, and Commercial Day Care Facility.

Section 2.13 Definitions-L

Large Solar Energy System: Removes the definition of Large Solar Energy System.

Section 2.18 Definitions-R

Renewable Energy Systems: Adds definitions for Large and Small-Scale Renewable Energy Systems.

Section 2.19 Definition-S

Solar Energy System: Adds definitions for Large and Small-Scale Solar Energy Systems.   

State Licensed Residential Facility: Amends definitions to make it comply with the State of Michigan requirements.


Section 2.23 Definitions-W

Wind Energy Systems: Amends the definitions of Large and Small Scale Wind Energy Systems.

Chapter 3 General Provisions

Section 3.09 Regulations Applicable To All Single Family Dwellings: Removed item F Compatibility Determination. 

Section 3.11 Fences and Walls: Adds walls to the regulations in this section.

Section 3.40 Grading: Adds regulations regarding grading on sites within the township.

Chapter 4 W-R Wilderness and Recreation District, Chapter 5 R-R Rural Residential District, Chapter 6 R-1 Medium Density Residential District, Chapter 7  L-R Lake Residential District, Chapter 8 L-C Lake Conservation District, Chapter 9 M-H-P Manufactured Home Park

Section 4.02, Section 5.02, Section 6.02, Section 7.02, Section 8.02, and Section 9.02 Permitted Uses: amended to verify compliance with the state requirements for state licensed residential facilities, family child care homes, and adult foster care homes. 

Section 4.03, Section 5.03, Section 6.03, Section 7.03, Section 8.03, and Section 9.03 Special Land Uses: Amended to verify compliance with the state requirements for group child care homes.

Chapter 14 Special Land Uses

Section 14.04 Special Land Use Specific Requirements:

item L Group Child Care Home: Amended to comply with the State of Michigan requirements,

Item II Large Scale Solar Energy Systems: Amended the setback requirements, and added a provision that  Large Scale Solar Energy Systems shall comply with any requirements adopted by the MPSC that conflict with the provisions in this Ordinance as provided in PA233 of 2023.

Item KK Wind Energy Systems: added a provision that Large Scale Wind Energy Systems shall comply with any requirements adopted by the MPSC that conflict with the provisions in this Ordinance as provided in PA233 of 2023.

Item LL Large Scale Batter Energy Storage Systems: Added regulations regarding Large-Scale Battery Energy Storage Systems. 

A copy of the full zoning text amendments may be inspected or purchased at the Township Offices (17751 N. Territorial Road, Chelsea, MI 48118). The new Zoning Ordinance Amendments will also be posted on the Township’s website at http://www.twp-lyndon.org/about_us/public_notices.php . The adopted amendment shall become effective 7 days after the notice is published, unless referendum procedures are initiated under MCL 125.3402 within seven (7) days after publication of this notice of adoption. If referendum procedures are initiated, the ordinance shall take effect in accordance with MCL 125.3402.
